Commitment #7: IMPLEMENTING AND MONITORING OF THE REGIME OF ACCESS TO ADMINISTRATIVE AND ENVIRONMENTAL INFORMATION

Description

Strengthening of the regime of access to administrative and environmental information, embodied in Law 26/2016, of 22 August, with a view to fostering access and reuse of administrative data produced by the public sector.

Milestone 1 - Appointment and identification of employee responsible for access to administrative and environmental information on the institutional website of all eligible public entities or, alternatively, publication of an aggregated list, in machine-readable form and updated quarterly on the Dados.gov web portal.

Milestone 2 - Publication, in the Dados.gov portal, of a preliminary list with the typologies of information and data produced and managed by each eligible public entity.

Milestone 3 - Provision of legally available metadata associated to all documents made public (issuer, date of application, date of availability and identification of the person responsible for the good continuation of the request for access).

Milestone 4 - Provision of information on policies and practices of access to information, including the identification of public entities and agents with good practices in the domain of access to information and the average time to make available the requested information.

Status Reports

The commitment only has a minimal progress. Assess the possibility to include its milestones in a forthcoming action plan, creating viable conditions for its realization, with clearly defined ownership, responsibilities and indicators to be used to monitor its progress.

NOTE: TI-PT has compiled a brief report with comments, to date, on the implementation of commitments # 7 and # 8 of the I National Open Administration Plan, which can be found here.

Regarding the Responsible for Access to Information (RAI), CADA currently has a record of 194. It should be noted that: 

  1. In order to meet the objectives of Milestone 1 (appointment and identification of employee responsible for access to administrative and environmental information on the institutional website of all eligible public entities or, alternatively, publication of an aggregated list, in machine-readable form and updated quarterly on the Dados.gov web portal) and Milestone 2 (publication, in the Dados.gov portal, of a preliminary list with the typologies of information and data produced and managed by each eligible public entity), the possibility of developing and hosting a webform on the CADA official website was accessed, where RAIs already nominated and / or identified and the respective public entities could be registered. On this hypothesis, we note the following developments:

    1. CADA has already prepared the database model to be implemented in relation to the information concerning the RAI; 

    2. However, CADA considers that the process should be implemented gradually, not least because there must always be a validation mechanism prior to the registration of RAI, which is still under development.  

  2. There no updates regarding Não há alterações a registar em relação à Milestone 3 (Provision of legally available metadata associated to all documents made public);

  3. With regard to Milestone 4 (Provision of information on policies and practices of access to information, including the identification of public entities and agents with good practices in the domain of access to information and the average time to make available the requested information), training and awareness-raising initiatives in which CADA would participate together with TI, have not been carried out given the current pandemic context. It should be noted that, once the current circumstance is overcome, CADA will always be available for that purpose. The actions that were defined by TI, with the support of CADA, were as follows:  

    1. Awareness campaign on transparency and access to administrative and environmental information:

      1. Webinar on “Transparency in administrative and environmental activity: opportunities and challenges” (it was pre-scheduled for March 24);

      2. Workshop on OpenGov Week (which was canceled for 2020);

      3. Awareness-raising activities via E-Learning.

 

CADA understands that its activity, namely through the issuing of Opinions (which have a pedagogical content), has contributed to strengthen the right of access. There are situations in which a public administrative entity did not allow access, and with the consolidation of the CADA doctrine, it now allows it.


CADA is always available to collaborate in training activities within the framework of its competencies.
